My MOMENTUM Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your download, access, and use of the My MOMENTUM - Habit Tracker mobile application and its associated website pages, provided by ADEX Soft Solutions ("ADEX Soft", "we", "us", or "our"). By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the application.

2. Description of the Application

My MOMENTUM is an iOS productivity and self-organization tool designed to help users track personal daily habits, organize daily routines, utilize step-by-step Focus Mode timers, participate in personal consistency challenges, and configure parent-guided morning and bedtime routines for children.

3. Medical and Health Disclaimer (CRITICAL)

NOT A MEDICAL, PSYCHIATRIC, OR CLINICAL SERVICE:

My MOMENTUM is an educational and organizational tool for personal routine planning. It does not provide medical, psychiatric, diagnostic, or clinical therapy services.

  • ADHD Organization: Focus Mode and visual task routines are intended to support day-to-day structure and task initiation. They do NOT diagnose, treat, prevent, or cure Attention Deficit Hyperactivity Disorder (ADHD) or any executive-function disorder.
  • Nutrition & Dietary Tracking: Lowering added sugar or tracking dietary habits is for personal awareness. The app makes NO guarantee that reducing sugar will clear acne or eliminate skin conditions.
  • Smoking Cessation: Recording smoke-free days is a supportive tracking aid. It is NOT a medical cessation treatment or a substitute for professional counseling and approved therapies.
  • Healthy Aging & Exercise: Physical activity recommendations are illustrative. Consult a qualified physician before starting any new exercise routine, especially if you have mobility, cardiovascular, or balance concerns.

4. Kids Mode & Parental Responsibility

Kids Mode is provided as a parent-guided family tool:

  • Parents or legal guardians must configure child profiles, habit goals, and routine steps.
  • The in-app 4-digit Parent PIN provides an in-app software boundary to prevent accidental changes by children. It does not control operating system controls, restrict overall device usage, or prevent app deletion.
  • Parents are solely responsible for supervising their children's device use and routine suitability.

5. In-App Purchases, Subscriptions, and Billing

Certain features of My MOMENTUM require a Premium subscription or one-time purchase:

  • Available Tiers: Weekly auto-renewing subscription ($2.99 USD), Monthly auto-renewing subscription ($5.99 USD), Yearly auto-renewing subscription ($24.99 USD), and Lifetime non-consumable purchase ($49.99 USD). Regional pricing may vary based on Apple App Store exchange rates and local taxes.
  • Payment Processing: Payment is charged to your Apple Account at confirmation of purchase through Apple StoreKit.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the period.
  • Managing Subscriptions: You can manage or cancel your subscription at any time in your iPhone Settings > [Your Name] > Subscriptions.
  • Refunds: All purchases and refunds are processed by Apple in accordance with Apple Media Services Terms and Conditions. ADEX Soft cannot process direct refunds for App Store transactions.

6. Intellectual Property & Permissible Use

All trademarks, logos, visual designs, software code, icons, and text related to My MOMENTUM and ADEX Soft are the proprietary intellectual property of ADEX Soft Solutions. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

7. Disclaimer of Warranties

My MOMENTUM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR PERSONAL OUTCOME EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADEX SOFT SOLUTIONS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws governing ADEX Soft Solutions, without regard to its conflict of law principles.
